Notice of Tariff Changes

NOTICE OF A CHANGE IN THE TARIFFS OF EMPIRE ELECTRIC ASSOCIATION, INC.

At its November 09, 2018 meeting, Empire Electric Association’s Board of Directors voted to edit EEA’s General Service, Irrigation, and Large Power tariffs.  No rate increases are planned for 2019.  The approved edits are all wording changes meant to add clarity and uniformity to EEA’s tariffs.

One notable edit involves changing size limitations from being based on average monthly demand to equipment capacity. This will hopefully eliminate some of the ambiguity association with average monthly demand. This will also link the tariffs to the size of the equipment installed, which aligns well with cost-based rate principles.  A second notable edit involves clarifying that the General Service tariffs are applicable to non-irrigation services.  Irrigation services are served under the Irrigation tariffs.  A third notable edit involves adding the clause “subject to any applicable franchise fees and/or sales tax” to tariffs that lacked this clause.  This is meant to clarify that all our tariffs are subject to applicable fees and taxes.

Below is a summary of the edits for each tariff:

  • General Service – Single-Phase
    • Size limit was changed from average monthly demand to equipment capacity. 
    • Availability section edited to clarify that this tariff is applicable to non-irrigation services.
  • General Service – Three-Phase
    • Size limit was changed from average monthly demand to equipment capacity. 
    • Availability section edited to clarify that this tariff is applicable to non-irrigation services.
    • The clause “subject to any applicable franchise fees and/or sales tax” was added to the Rate section.
  • Irrigation – Single-Phase
    • Size limit was changed from average monthly demand to equipment capacity. 
  • Irrigation – Three-Phase
    • Size limit was changed from average monthly demand to equipment capacity. 
    • The clause “subject to any applicable franchise fees and/or sales tax” was added to the Rate section.
  • Large Power
    • Size limit was changed from average monthly demand to equipment capacity. 
    • The clause “subject to any applicable franchise fees and/or sales tax” was added to the Rate section.

These changes are scheduled to go into effect on January 1, 2019.  Anyone who desires to complain about the proposed changes shall file a written complaint with the EEA at 801 North Broadway, Cortez, Colorado, 81321, at least 10 days before the proposed effective date.

The Cooperative may hold a hearing to determine what changes will be authorized.  The changes ultimately authorized may or may not be the same as those proposed and may include changes different than those tariffs proposed or currently in effect.  Anyone who desires to receive notice of hearing, if any, shall make a written request therefore to EEA, at the above address, at least 10 days before the proposed effective date
